1. Overview

This website and online store (the "Site") is operated by FusiaX L.L.C., a Wyoming limited liability company doing business as Bremara House ("Bremara House", "we", "us"). By using the Site or placing an order, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. We currently accept orders for delivery within the United States only.

3. Products and descriptions

We try to describe and show our products as accurately as possible. Colors may look different on different screens, and items made from natural materials such as clay, cement, wood, willow, seagrass and linen vary slightly in tone, texture and size. Measurements are approximate. Ceramic and cement products are for decorative use only and are not intended for food, drink or holding water unless the product page says otherwise.

4. Prices and payment

All prices are in US dollars. Prices and availability may change without notice. Applicable sales tax and shipping are shown at checkout. Payment is taken at checkout through our payment providers. We reserve the right to correct pricing or description errors and to cancel orders affected by such errors; if we cancel an order you have paid for, we will refund you in full.

5. Orders

Your order is an offer to buy. We may accept or decline an order, or limit quantities, for example if an item is out of stock or we suspect fraud. An order is accepted when we ship it. You can change or cancel an order within 12 hours of placing it if it has not yet shipped.

6. Shipping, returns and refunds

Shipping is governed by our Shipping Policy and returns and refunds by our Refund Policy, both of which form part of these Terms. Title and risk of loss pass to you when the item is delivered to the carrier, without affecting your rights under our Refund Policy for items that arrive damaged.

7. Intellectual property

The Bremara House name, logo, product designs, artwork, photographs and text on the Site belong to FusiaX L.L.C. or its licensors. You may not copy, reproduce or use them for commercial purposes without our written permission.

8. Acceptable use

You agree not to misuse the Site, including by attempting to interfere with its operation, accessing it by automated means without permission, placing fraudulent orders, or using it for any unlawful purpose.

9. Third-party services

The Site runs on Shopify and uses third-party payment and shipping services. Your use of those services may also be subject to their own terms.

10. Disclaimer

Except as stated in these Terms or required by law, the Site and products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be waived.

11. Limitation of liability

To the fullest extent permitted by law, FusiaX L.L.C. will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim related to a product will not exceed the amount you paid for that product.

12. Indemnification

You agree to indemnify and hold harmless FusiaX L.L.C. from claims arising from your breach of these Terms or misuse of the Site.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Before filing any claim, please contact us so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Wyoming, unless the law of your state of residence gives you the right to bring it elsewhere.

14. Changes to these Terms

We may update these Terms from time to time. Changes apply to orders placed after the updated Terms are posted. The "Last updated" date above shows when they last changed.
